These Terms apply to the Pepteon Care mobile application and related
website at pepteoncare.com and any associated services
(together, the “Service”).
1. Acceptance of These Terms
These Terms & Conditions (“Terms“) are a binding
agreement between you (“you,” “your,”
or “User“) and Pepteon Management Services,
LLC (“Pepteon Care,” “we,”
“us,” or “our“).
By creating an account, connecting a data source, pairing with a
provider code, or otherwise accessing or using the Service, you
acknowledge that you have read, understood, and agree to be bound by
these Terms and by our Privacy Policy (available at
pepteoncare.com/privacy-policy/), which is incorporated by reference.
If you do not agree, do not access or use the
Service.
If you are entering into these Terms on behalf of another person or
an organization, you represent that you are authorized to bind them.
2. Eligibility
You must be at least 18 years old and legally able
to enter into a binding contract to use the Service. The Service is
intended for adults and is not directed to children
under 18. By using the Service you represent and warrant that you meet
these requirements. We may suspend or terminate any account we
reasonably believe belongs to a person under 18.
Telehealth availability depends on where a Provider is licensed (see
Section 5). You are responsible for compliance with the laws that apply
to you in your location. We make no representation that the Service is
appropriate or available for use in any particular location.
3. What the Service Is (and Is
Not)
Pepteon Care is a health-data and care-coordination
technology platform. In plain terms, the Service lets you
track your health data and stay connected to your care
team. Specifically, the Service may allow you to:
- Create an account and pair with an independently licensed
clinician (“Provider“) using a pairing
code; - Connect and aggregate your own health data from
third-party sources you authorize — including Oura Ring
(via OAuth), Apple Health / HealthKit, and
at-home blood-biomarker results you upload (e.g., a
RhythmHealth CSV or PDF) — into a single, longitudinal record; - Log subjective check-ins and other information you
choose to enter; - View trends over time in your own data and any
notes shared with you by your Provider; - Communicate with your care team through the
Service; and - Receive educational, plain-language explanations of
your own data through an in-app assistant (see Section 6).
What the Service is NOT. The Service is a
technology and coordination platform. It is
not itself a medical practice, a pharmacy, a
laboratory, a prescriber, or a provider of medical care, diagnosis, or
treatment. The Service does not sell, dispense, recommend, or
supply any drug, peptide, or other product, and it does
not generate or deliver a treatment plan, protocol, or dose to
you. Any clinical care you receive is provided by your independent
Provider, not by Pepteon Care (see Section 5).

Medical Disclaimer — Please Read
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL
ADVICE, DIAGNOSIS, OR TREATMENT.
- The content, data visualizations, trends, scores, and assistant
messages in the Service are provided for informational and
organizational purposes only. They are not
medical advice and must not be treated as such.- Using the app by itself does not create a doctor–patient
relationship between you and Pepteon Care or with any
clinician. A clinical relationship is formed only if and when you
separately engage an independently licensed Provider and that Provider
accepts you as a patient under their own professional terms (see Section
5).- Always seek the advice of a qualified, licensed health
professional with any questions you have about a medical
condition, your data, any medication or substance, or before starting,
stopping, or changing anything related to your health. Never
disregard professional medical advice or delay seeking it because of
something you saw in the Service.- Do not rely on the Service in an emergency. The
Service is not designed or intended for emergencies and
is not monitored in real time. If you think you may have a
medical emergency, call your local emergency number (in the U.S., 911)
or go to the nearest emergency room immediately.No wearable metric, biomarker value, trend, or “score” shown in the
Service is a diagnosis or a treatment decision. Reference ranges and
status indicators are supplied by the third-party sources you connect
and may be incomplete or inaccurate.

Providers — The Care Relationship Is Between You and the Clinician
Pepteon Care is the technology and coordination platform, not
your medical provider. Telehealth and clinical services, if
any, are provided by independent, separately licensed
clinicians (“Providers”), each of whom is solely responsible
for the care they provide and for exercising independent professional
medical judgment.
You acknowledge and agree that:
- The provider–patient relationship is exclusively between you
and your Provider, not with Pepteon Care. Your Provider — not
Pepteon Care — is responsible for all clinical decisions, diagnoses,
treatment, prescriptions (if any), and follow-up. - Providers practice independently. Pepteon Care
operates as a management-services organization (an “MSO”) that provides
the technology platform and administrative support to an independent
professional entity and its clinicians. Pepteon Care does not control or
interfere with the exercise of clinical judgment. - Licensure follows the patient’s location. A
Provider may treat you only if the Provider is licensed in the U.S.
state (or other jurisdiction) where you are physically
located at the time of care. You agree to provide accurate
information about your location. - Separate terms may apply. Your Provider may require
you to accept separate clinical-services terms, informed-consent forms,
and telehealth-consent documents that govern the care relationship.
Those documents, not these Terms, govern the clinical care itself. - We do not control provider availability or
outcomes. We do not guarantee that a Provider will be available
to you, will accept you as a patient, or will reach any particular
result. Pairing with a Provider code in the app is a technical
connection only and does not by itself establish care. Describing a
clinician as “Pepteon-certified” reflects completion of Pepteon Academy
education and is not a guarantee of any clinical outcome.
6. AI Co-Pilot / In-App
Assistant
The Service includes an AI-assisted feature (the
“Co-Pilot“). You acknowledge and agree that:
- The Co-Pilot is decision-support and education
only. For clinicians, it summarizes and narrates a patient’s
own data and may surface possible items for the clinician’s
consideration. It is not autonomous, it does
not make clinical decisions, and a licensed clinician
remains fully in the loop and responsible for any
decision. - The Co-Pilot is not a medical device and does not diagnose
or treat. It does not diagnose any condition, does not
prescribe, and never gives you a dose, a drug, a peptide, or a
protocol. It is not intended to be, and should not be relied
upon as, a substitute for professional medical judgment. - Patient-facing output is explanatory only. For
patients, the Co-Pilot explains your own numbers in plain language and
encourages you to check in and to raise clinical questions with your
Provider. It routes protocol and treatment questions to your
Provider. - AI has limitations. AI-generated content may be
incomplete, out of date, or incorrect. Do not act on Co-Pilot output
without confirmation from a qualified professional. You use it at your
own discretion and risk, subject to Sections 4, 15, and 16.
7. Accounts, Registration
& Security
To use most features you must create an account. You agree to (a)
provide accurate, current, and complete information; (b) keep it
updated; (c) keep your login credentials confidential; and (d) be
responsible for all activity under your account. You must notify us
promptly at care@pepteoncare.com if
you suspect unauthorized use. We may offer or require Sign in
with Apple and other authentication methods. We may refuse,
suspend, or terminate accounts as described in Section 13.
8. No
Drug, Therapeutic, or Efficacy Claims; Research-Use Context
The Service is a data-tracking and care-coordination tool.
Pepteon Care makes no claim that any peptide, supplement,
medication, or other product is safe, effective, or appropriate to
diagnose, treat, cure, or prevent any disease or condition.
Nothing in the Service is an offer to sell, or a solicitation to buy,
any product, nor a recommendation to use any product.
You acknowledge that certain products discussed in the broader
Pepteon ecosystem may be sold by third parties on a “Research
Use Only” (RUO) basis and are not approved for
human use, and that any decision regarding any such product rests solely
with you and your licensed Provider. Pepteon Care does not supply,
dispense, or direct the use of any such product through the Service.
9. Third-Party Services
and Data Sources
The Service lets you connect third-party sources and services,
including Oura, Apple Health /
HealthKit, and RhythmHealth (each a
“Third-Party Service“). You acknowledge and agree
that:
- You authorize the connection. By connecting a
Third-Party Service (e.g., completing Oura’s OAuth flow, granting
HealthKit permissions, or uploading your RhythmHealth results), you
represent that you have the right to do so and you
consent to Pepteon Care receiving, storing, and
processing that data to provide the Service and to build your
longitudinal record, as further described in the Privacy Policy. - Third-Party Services have their own terms. Your use
of each Third-Party Service is governed by that provider’s own
terms and privacy policy, not these Terms. We are not
responsible for Third-Party Services, their availability, or their data
accuracy. - We honor source restrictions. Data obtained through
certain sources (including Apple HealthKit and Oura) is subject to
restrictions imposed by those providers — for example, restrictions on
advertising use and resale. We will handle such data consistent with
those restrictions and with our Privacy Policy. - You can disconnect. You may revoke a connection at
any time through the Service or the Third-Party Service; revocation
stops future data collection but does not by itself delete data already
received (see Section 12 and the Privacy Policy).
Apple, Oura, and RhythmHealth are not parties to these Terms, do not
sponsor or endorse the Service, and have no obligation to provide
support for it, except as any applicable app-store or platform terms
expressly require.
10. User Content and Your
Data
You may submit information to the Service, including uploaded lab
results, check-ins, notes, and messages (“User
Content“). You retain your rights in your User Content. You
grant Pepteon Care a limited, non-exclusive license to host, store,
process, and display your User Content solely to operate and
provide the Service to you and your care team, and as otherwise
described in the Privacy Policy.
- You are responsible for your User Content,
including that you have the right to submit it and that it is
accurate. - De-identified/research use is separate and opt-in.
Any use of your information for research or aggregate analytics is
governed by the Privacy Policy and requires your separate,
opt-in consent; it is not bundled into your acceptance of these
Terms or into your care. - Health-data handling, security, retention, and your privacy
rights (including any applicable HIPAA and state-law rights)
are described in the Privacy Policy, which controls
over these Terms on those subjects.
11. Acceptable Use
You agree not to, and not to permit anyone to:
- use the Service for any unlawful, harmful, or fraudulent purpose, or
in violation of these Terms or any applicable law or third-party
right; - misrepresent your identity, age, location, or clinical information,
or use another person’s account or a pairing code you are not authorized
to use; - upload data you do not have the right to share, or data about
another person without authorization; - attempt to obtain a prescription, dose, or protocol through
deception, or to use the Service to circumvent a Provider’s clinical
judgment; - reverse engineer, decompile, scrape, or attempt to access non-public
areas of the Service, or interfere with its security or operation; - introduce malware, overload the Service, or use it to build a
competing product or dataset; or - use any output of the Service as if it were medical advice, a
diagnosis, or a treatment decision.
We may investigate and take appropriate action, including suspension
or termination, for any violation.
12. Fees and Billing
- The app is free to use while you are under active care with
a Pepteon-certified Provider. Access to app features may depend
on maintaining an active care relationship. - Telehealth/clinical services are paid. Fees for
clinical care are set and charged as part of your care relationship by
your Provider or its affiliated billing entity, and are disclosed to you
before you pay. - Payment processing is handled by a third-party
payment processor, subject to its terms. You authorize the applicable
charges and represent that your payment information is accurate. - Taxes. You are responsible for any applicable taxes
except those based on our net income. - Changes to fees will be communicated in advance as
required by applicable law. If you purchase anything through the Apple
App Store, Apple’s in-app-purchase and billing rules also apply.
13. Term, Termination
& Account Deletion
- These Terms apply while you use the Service.
- You may stop using the Service and delete your account at
any time through the in-app account-deletion function or by
contacting care@pepteoncare.com.
Deleting your account is described, together with data retention and any
legal-retention obligations for health records, in the Privacy
Policy. - We may suspend or terminate your access, with or
without notice, if you violate these Terms, if required by law, if a
Third-Party Service or platform requires it, or to protect the Service
or others. - Ending your app account does not by itself
terminate any separate clinical-care relationship or obligations you
have with your Provider, which are governed by the Provider’s own terms.
Certain clinical/medical records may be retained by your Provider for a
period required by law. - Sections that by their nature should survive termination (including
Sections 8, 10, 14, 15, 16, 17, and 18) will survive.
14. Intellectual Property
The Service, including its software, design, text, graphics, logos,
“Pepteon Care” and related marks, and all associated intellectual
property, is owned by Pepteon Care or its licensors and is protected by
law. We grant you a limited, personal, non-exclusive, non-transferable,
revocable license to use the Service for your own personal,
non-commercial use, subject to these Terms. All rights not expressly
granted are reserved. You may not use our marks without prior written
permission. Feedback you provide may be used by us without obligation to
you.
15. Disclaimers of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT
WARRANTIES OF ANY KIND, whether express, implied, or statutory,
including any implied warranties of merchantability, fitness for a
particular purpose, title, non-infringement, and any warranties arising
from course of dealing or usage of trade, to the fullest extent
permitted by law.Without limiting Section 4, we do not warrant that:
the Service will be uninterrupted, secure, timely, or error-free; the
data, trends, scores, or Co-Pilot output are accurate, complete, or
current; data from Third-Party Services is accurate or reliable; or the
Service will meet your requirements or produce any particular health
outcome. You use the Service, and any information in it, at your
own risk. Some jurisdictions do not allow certain warranty
exclusions, so some of the above may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, in no event
will Pepteon Care or its affiliates, officers, employees, agents, or
licensors be liable for any indirect, incidental, special,
consequential, exemplary, or punitive damages, or for any loss
of profits, revenue, data, goodwill, or other intangible losses, arising
out of or relating to your use of (or inability to use) the Service,
even if advised of the possibility of such damages.To the fullest extent permitted by law, Pepteon Care’s total
aggregate liability for all claims relating to the Service will
not exceed the greater of the amounts you paid to Pepteon Care for the
Service in the 12 months before the claim, or US
$100.Nothing in these Terms limits liability that cannot be
limited by law, including, where applicable, liability for
gross negligence, willful misconduct, or personal injury caused by our
negligence. Pepteon Care is not liable for the acts, omissions,
or clinical decisions of any independent Provider or Third-Party
Service (see Sections 5 and 9).
17. Indemnification
To the fullest extent permitted by law, you agree to indemnify,
defend, and hold harmless Pepteon Care and its affiliates, officers,
employees, and agents from and against any claims, liabilities, damages,
losses, and expenses (including reasonable attorneys’ fees) arising out
of or related to: (a) your misuse of the Service; (b) your violation of
these Terms or any law or third-party right; (c) your User Content or
data you connect or upload; or (d) your interactions with a Provider or
a Third-Party Service. We may assume the exclusive defense of any matter
subject to indemnification, and you agree to cooperate.
18. Governing Law &
Dispute Resolution
- Governing law: These Terms are governed by the laws
of the State of Wyoming, without regard to
conflict-of-laws rules. - Informal resolution first: Before filing any claim,
you agree to contact us at care@pepteoncare.com and
attempt to resolve the dispute informally for at least 30
days. - Venue: Except where prohibited by applicable law,
you and Pepteon Care agree to the exclusive jurisdiction of the state
and federal courts located in Wyoming for any dispute not resolved
informally. - No effect on medical/regulatory rights: Nothing
here waives any non-waivable statutory or patient right, or any right
you may have to bring a claim in small-claims court.
19. Changes to These Terms
We may update these Terms from time to time. If we make material
changes, we will provide reasonable notice (for example, by posting the
updated Terms with a new “Last updated” date or by in-app or email
notice). Changes are effective when posted unless stated otherwise or
unless applicable law requires prior consent. Your continued use of the
Service after changes take effect means you accept the updated
Terms.
20. Miscellaneous
- Entire agreement: These Terms and the Privacy
Policy are the entire agreement between you and Pepteon Care regarding
the Service and supersede prior agreements on that subject. - Severability: If any provision is unenforceable,
the rest remains in effect. - No waiver: Our failure to enforce a provision is
not a waiver. - Assignment: You may not assign these Terms without
our consent; we may assign them in connection with a merger,
acquisition, or sale of assets. - No agency: These Terms do not create any agency,
partnership, or employment relationship, including between you and any
Provider and Pepteon Care. - Force majeure: We are not liable for delays or
failures due to events beyond our reasonable control. - Apple App Store terms: If you download the app from
the Apple App Store, you agree that Apple is a third-party beneficiary
of these Terms and may enforce them, and that Apple’s applicable
Licensed Application End User License Agreement and app-store terms also
apply.
